Terms of Service and User Agreement

1.0 Acceptance of Terms and General Applicability This Terms of Service and User Agreement (the “Agreement”) constitutes a legally binding contract between the operator of this digital commerce platform (hereafter referred to as the "Company", "We", or "Us") and the end-user, consumer, or entity accessing the platform (hereafter referred to as the "User", "Customer", or "You"). By accessing, browsing, interacting with, or executing a transaction on this platform, the User explicitly acknowledges, comprehends, and unconditionally agrees to be bound by all stipulations, policies, and operating rules embedded herein. The Company reserves the unilateral right to amend, modify, or supersede these terms at its sole discretion without prior explicit notification.

2.0 Product Specifications and Artisanal Variance Acknowledgment The Company specializes in the curation of raw crafting materials and the fabrication of artisanal epoxy resin goods. The Customer expressly recognizes and accepts the inherent variables associated with handcrafted and chemically cured products:

  • Dimensional Tolerances: Specifications provided for raw materials—including but not limited to the approximately four (4) millimeter thickness of MDF bases, twenty-two (22) millimeter clock mechanism shafts, and standardized acrylic cut-outs—are approximate. Fractional discrepancies are inherent to the manufacturing and cutting process and do not constitute a breach of contract.

  • Artisanal Imperfections: The chemical curing process of epoxy resin naturally yields microscopic air bubbles, slight textural variations, and minor color or pigment shifts. Furthermore, organic inclusions (such as preserved botanicals or Varmala petals) and metallic electroplated granules will settle uniquely in every pour. The Customer agrees that these organic variables are hallmarks of bespoke craftsmanship and shall not be classified as structural or aesthetic defects.

3.0 Custom Commissions and User Obligations When contracting the Company for bespoke merchandise, including personalized statement clutches, custom-engraved nameplates, or botanical preservation plaques, the Customer assumes full liability for the accuracy of all provided data.

  • Data Accuracy: The Customer is solely responsible for ensuring the absolute accuracy of submitted monograms, dates, typographical requests, and structural preferences. The Company assumes no liability for typographical errors originating from the Customer’s submission.

  • Material Provision: For projects necessitating customer-supplied organic matter (e.g., wedding garlands), the Customer bears full responsibility for the timely and secure transit of said materials to our facilities. The Company is not liable for the degradation, rot, or damage of organic materials during inbound transit.

4.0 Intellectual Property Rights and Copyright Enforcement All digital infrastructure, textual content, visual documentation, proprietary resin casting methodologies, graphic designs, and product silhouettes displayed on this platform are the exclusive intellectual property of the Company.

  • Prohibition of Misappropriation: The User is strictly prohibited from reproducing, duplicating, scraping, reverse-engineering, or commercially exploiting any proprietary designs or imagery without express, legally binding written authorization from the Company. Violations will be subject to immediate legal remediation and claims for statutory damages.

5.0 Financial Provisions, Pricing, and Contract Formation

  • Pricing Accuracy: While the Company endeavors to maintain rigorous pricing accuracy, typographical errors or inventory discrepancies may occur. The display of an item on the platform constitutes an invitation to treat, not a legally binding offer.

  • Right of Refusal: The Company reserves the unilateral right to refuse, restrict, or cancel any order at its sole discretion—including post-transaction execution—in the event of a pricing anomaly, suspected fraudulent activity, or unforeseen supply chain disruption. In such instances, a full reversal of funds will be executed.

6.0 Limitation of Liability and Indemnification To the maximum extent permitted by applicable jurisprudence, the Company, its artisans, affiliates, and logistical partners shall not be held liable for any indirect, incidental, punitive, or consequential damages arising from the procurement or utilization of our merchandise.

  • Usage Liability: The Customer assumes all risk associated with the use of raw materials (including handling chemical epoxy systems, UV resins, and hardeners) and the structural mounting of finished goods (such as wall clocks or heavy resin plaques). The Company's total aggregate liability under any circumstances shall be strictly capped at the quantum of the original purchase price of the disputed merchandise.

7.0 Severability and Governing Law Should any single clause or provision of this Agreement be deemed unenforceable, invalid, or contrary to law by a court of competent jurisdiction, such invalidity shall not nullify or compromise the enforceability of the remaining provisions. This Agreement shall be governed, construed, and enforced strictly in accordance with the standard commercial laws of the operating jurisdiction, rendering any disputes subject to exclusive local arbitration and adjudication.
